A Philadelphia man has been indicted on five federal charges arising from the Oct. 10 shooting that killed Philadelphia police officer Shane Seiber and seriously wounded his partner, Officer Hector Rodriguez III, U.S. Attorney David Metcalf announced Thursday, Oct. 22.
The indictment charges Eric Lewis, 35, of Philadelphia, with interference with interstate commerce by robbery, discharging a firearm during a crime of violence, possession of a firearm and ammunition by a felon, theft of a firearm that has moved in interstate commerce, and possession of a stolen firearm and stolen ammunition, according to the U.S. Attorney's Office for the Eastern District of Pennsylvania.
The indictment alleges that on the night of Oct. 10, Lewis, who had a loaded privately manufactured 9mm handgun, known as a ghost gun, and a loaded 12-gauge short-barreled shotgun, shot Seiber and Rodriguez, then took a police-issued Glock 17 handgun from the wounded Rodriguez, the office said. Prosecutors said Lewis had a prior conviction that barred him from having firearms or ammunition.
If convicted, Lewis faces a maximum of life in prison and a mandatory minimum of 10 years, prosecutors said.
"No one attacks law enforcement without facing the consequences," Metcalf said. "Our thoughts remain with Officer Seiber's loved ones and the Philadelphia Police Department. We also continue to pray for a swift and complete recovery for Officer Rodriguez."
"These charges represent another important step toward justice for Shane, Hector, and their families," Philadelphia Police Commissioner Kevin J. Bethel said in the release.
"The charges and allegations contained in the indictment are merely accusations. Every defendant is presumed to be innocent unless and until proven guilty in court," the office said.
What is not known
The release does not give a date for Lewis's next court appearance or name a defense lawyer.
